These Terms of Service (“Terms”) are a legally binding agreement between you and WoBazi (“WoBazi,” “we,” “us,” or “our”) governing your access to and use of wobazi.com and related services (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
WoBazi provides BaZi (Four Pillars of Destiny) calculations, interpretive readings, compatibility tools, and an AI-assisted “Oracle.” Features may change, be interrupted, or be discontinued at any time. Some features require a Google account. A basic reading is offered without charge; we may introduce paid features later.
2. Eligibility
You must be at least 16 years old, or the age of digital consent in your country if higher, and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.
3. Accounts
You may sign in with Google. You are responsible for activity under your account and for keeping access to that Google account secure. We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe create risk. You may stop using the Service at any time. To delete stored account data, contact hello@wobazi.com.
4. Your content
You retain rights in the information you submit (such as birth data and chat messages) (“User Content”). You grant WoBazi a worldwide, non-exclusive, royalty-free license to host, process, and display User Content solely to operate, secure, and improve the Service, including sending necessary context to AI providers to generate a response you request.
You represent that you have the right to submit User Content, that it is accurate to the best of your knowledge, and that it does not violate law or others’ rights. Do not submit sensitive information you do not want processed as described in our Privacy Policy.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to harass, defraud, or harm others.
- Attempt to probe, scan, reverse engineer, or disrupt the Service, or bypass rate limits, access controls, or security.
- Scrape, harvest, or bulk-download content except as allowed by ordinary browser use or written permission.
- Misrepresent your identity or birth data in a way intended to deceive others, or impersonate WoBazi.
- Use the Service to provide professional, licensed, or regulated advice to third parties as if it were WoBazi’s advice.
- Upload malware or interfere with other users’ use of the Service.
6. Intellectual property
The Service, including software, design, text, graphics, logos, and compilation of the BaZi presentation, is owned by WoBazi or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable, non-sublicensable license to access the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from the Service except as the law allows (for example, fair use of brief quotations).
If you send feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.
7. Entertainment; no professional advice
The Service is for entertainment, cultural education, and self-reflection only. BaZi, astrology, fortune scores, and Oracle output are not medical, mental-health, financial, legal, or other professional advice, and they are not a substitute for advice from a qualified professional. You should not make health, financial, legal, or other significant decisions solely on the basis of a reading. You use the Service at your own risk.
8. AI-generated output
Oracle answers and some daily readings are generated by automated systems and may be incomplete, inaccurate, or inconsistent. Output does not represent the views of WoBazi. You are responsible for how you interpret and use it. We do not guarantee that any reading is unique, correct, or suitable for any purpose.
9. Third-party services
The Service depends on third parties, including Google (sign-in), hosting providers, and AI providers. Their terms and privacy policies apply to their services. We are not responsible for third-party services, outages, or changes.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOBAZI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT READINGS WILL BE ACCURATE OR MEET YOUR EXPECTATIONS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOBAZI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
12. Indemnity
You will defend, indemnify, and hold harmless WoBazi and its personnel from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate access immediately if you violate these Terms or if we reasonably believe it is necessary to protect the Service or others. Upon termination, the license granted to you ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
14. Changes to the Service or Terms
We may modify these Terms or the Service at any time. We will update the “Last updated” date and, for material changes, provide notice as required by law (for example, a notice on the site). Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except that the United Nations Convention on Contracts for the International Sale of Goods does not apply. You and WoBazi submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, except that WoBazi may seek injunctive relief in any jurisdiction, and you may have additional consumer rights that cannot be waived in your country of residence.
If you are a consumer in the European Union, these Terms do not deprive you of the mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts.
16. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and WoBazi regarding the Service and supersede prior agreements on that subject.
Severability. If a provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Waiver. Failure to enforce a provision is not a waiver of the right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, or by operation of law.
No third-party beneficiaries. These Terms do not create rights in any third party except as stated for our personnel in the limitation of liability and indemnity sections.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
